Welcome to RS Web Creators.
These Terms & Conditions (“Terms”) govern your use of https://rswebcreators.com/ and your purchase or use of website design, development, branding, graphic design, eCommerce, digital marketing, maintenance, and related services provided by RS Web Creators (“we,” “us,” or “our”).
By using our website, submitting a project order, or purchasing our services, you agree to these Terms, subject to applicable law.
Additional terms may appear in a written proposal, quotation, invoice, service agreement, or statement of work. If there is a conflict, the specifically agreed written project terms will control for that project, except where applicable law requires otherwise.
Our services are intended for individuals aged 18 or older and businesses represented by authorized individuals.
By placing an order on behalf of an organization, you confirm that you are authorized to enter into an agreement for that organization.
RS Web Creators provides digital services, which may include:
The specific deliverables, project timeline, number of pages, features, integrations, revisions, and pricing will be defined in the applicable package description, quotation, invoice, or written project agreement.
Features not expressly included in the agreed scope may require an additional quotation and customer approval.
Prices displayed on our website are informational offers for the services described and may vary according to project requirements.
Before accepting payment, we aim to communicate the agreed package, deliverables, total charges, payment schedule, and any known exclusions.
Unless otherwise stated in writing:
Third-party costs may include domain registration, hosting, premium themes, licensed plugins, software subscriptions, payment gateway fees, advertising budgets, or external integrations.
We will not intentionally add undisclosed service charges to an agreed project without informing the customer and obtaining any required approval.
Payment requirements will be communicated in the quotation, invoice, or project agreement.
Projects may require an initial payment before work begins. Where installment payments are agreed upon, the remaining amounts become payable according to the agreed milestones.
For example, a project may require an initial deposit followed by a second payment after approval of an initial design.
Unless otherwise agreed, final deployment, transfer of completed deliverables, or release of project source files may be conditional on payment of the outstanding agreed balance.
Any payment processing fees or other charges must be disclosed where required by applicable law.
Customers should retain copies of invoices and payment confirmations.
To begin a project, the customer may need to provide:
Customers are responsible for ensuring that materials they provide are accurate, lawful, and appropriately licensed.
Delays in supplying required information, content, credentials, or approvals may affect the project schedule.
We will communicate material scheduling changes where reasonably practicable.
The number and scope of revisions included in a project will be determined by the agreed package or written proposal.
A revision generally means a reasonable modification to an existing design or deliverable within the original approved project scope.
A request that substantially changes the approved design direction, adds new features, introduces additional pages, or alters the original project requirements may be treated as additional work.
Where a package expressly includes unlimited revisions, that commitment applies to reasonable revisions within the agreed scope and active design phase, subject to the specific written package terms.
Revisions do not automatically include unlimited new concepts, complete project rebuilds, or additional services unless expressly agreed.
We will notify the customer before performing additional billable work.
Estimated timelines depend on project complexity, customer cooperation, third-party dependencies, and the agreed scope.
Unless expressly guaranteed in writing, estimated turnaround times are not unconditional delivery guarantees.
Initial design concepts, development milestones, and final delivery dates will be communicated as part of the project process.
We will make reasonable efforts to meet agreed schedules and communicate material delays.
Customers are responsible for reviewing deliverables and communicating requested corrections or changes within a reasonable period.
Approval of a design concept or project milestone authorizes work to proceed to the next agreed stage.
Approval does not eliminate statutory consumer rights or remedies for services that fail to meet applicable legal requirements.
Material changes requested after approval may require additional time or charges if they fall outside the agreed scope.
Website deployment may require access to hosting, domain registration, DNS settings, content management systems, or third-party services.
Customers may provide access through delegated permissions or another reasonably secure method.
We may recommend or integrate third-party platforms, but their availability, pricing, licensing, and terms are governed by the relevant providers.
Unless expressly included in writing, ongoing hosting, domain renewals, premium subscriptions, security monitoring, maintenance, and third-party service fees are not automatically included in a one-time website design purchase.
We will identify material recurring costs before customers authorize them.
Customers retain ownership of original materials they provide to us.
Unless otherwise stated in a written agreement, ownership of original, custom-created final deliverables will transfer to the customer upon receipt of full payment, to the extent those rights are owned by RS Web Creators and are transferable.
This transfer does not include:
Third-party components remain subject to their applicable license terms.
We may use customer-provided materials solely as reasonably necessary to perform the agreed services.
We will not publicly present confidential customer materials as portfolio work without appropriate permission.
We recognize that customers may provide confidential business information during a project.
We will use reasonable measures to protect confidential information and limit its use to providing services, administering the customer relationship, or complying with legal obligations.
Where a separate nondisclosure agreement is executed, its specific terms will apply.
Customers should avoid sharing passwords or highly sensitive information through unsecured communication channels.
Customers may request cancellation or a refund by contacting info@rswebcreators.com and providing their name, project details, and relevant invoice or order reference.
Refund requests will be reviewed based on:
Before work begins: Customers may request cancellation. Any refund or deduction will depend on the agreed terms, authorized expenses already incurred, and applicable law.
After work begins: Refund eligibility may depend on the amount of work completed, the agreed milestones, and the circumstances of the request. We will provide an explanation of any applicable deductions.
After delivery: Requests relating to defects, missing agreed deliverables, or service failures will be reviewed under the project agreement and applicable law.
Third-party charges: Domain registrations, hosting fees, software licenses, and other third-party purchases may be non-refundable to the extent permitted by law, where the charges and conditions were properly disclosed.
No provision in these Terms removes rights or remedies that cannot legally be excluded.
If a specific package includes a money-back guarantee, its exact eligibility conditions, duration, and exclusions must be clearly disclosed to the customer before purchase. Any expressly agreed guarantee will be honored according to its stated terms and applicable law.
Refunds approved by RS Web Creators will ordinarily be processed through the original payment method where feasible. Processing times may depend on the payment provider.
Any request outside the agreed scope may require a revised quotation.
We will communicate additional charges and seek the customer's authorization before proceeding with separately billable work.
Customers are not obligated to purchase additional services merely because those services are recommended.
Support and maintenance are provided according to the applicable package or service agreement.
Unless specifically included, ongoing website maintenance, content updates, backups, security monitoring, and third-party software updates may require separate arrangements.
Where a post-delivery correction or warranty period is offered, its duration and coverage will be specified in writing.
We will address valid service-related concerns in accordance with the agreed terms and applicable law.
Where RS Web Creators provides SEO, digital marketing, advertising, or related services, results may depend on market conditions, competition, advertising budgets, platform policies, and other factors outside our control.
Unless expressly agreed in writing, we do not guarantee specific search engine rankings, website traffic, sales, leads, or revenue outcomes.
Any performance forecasts are estimates rather than guaranteed results.
Customers agree not to use our website or services for unlawful, fraudulent, abusive, or infringing activities.
Customers must have appropriate rights or permissions to use any content, trademarks, images, software, or other materials provided for a project.
We may decline or suspend work involving unlawful content or conduct, subject to our contractual obligations and applicable law.
We make reasonable efforts to maintain accurate information on our website.
However, website content may contain errors or become outdated.
We may update service descriptions, website content, and publicly advertised offers. Changes to an existing paid project will remain subject to the agreed contract and applicable law.
We do not guarantee uninterrupted website availability.
To the extent permitted by applicable law, RS Web Creators will not be responsible for indirect or consequential losses arising from circumstances outside its reasonable control.
Any contractual limitation of liability must be interpreted consistently with applicable law and the specific written agreement between the parties.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or other non-excludable obligations.
Our collection and handling of personal information are described in our Privacy Policy:
https://rswebcreators.com/privacy-policy/
By submitting personal information, you acknowledge that it will be handled as described in that policy, subject to any applicable consent requirements.
We may revise these Terms periodically.
The revised version will be published on this page with an updated effective date.
Changes will not retroactively alter the agreed commercial terms of an existing project without an appropriate legal basis or the parties' agreement.
If a concern arises regarding our services, customers are encouraged to contact us first so we can attempt to resolve the issue.
Please provide relevant project details and a description of the concern.
Any unresolved dispute will be addressed in accordance with the applicable project agreement and governing law.
Nothing in these Terms prevents customers from exercising non-waivable legal rights or pursuing remedies available under applicable law.
The governing law and dispute-resolution jurisdiction for a paid project will be identified in the applicable service agreement where necessary.
Where no such agreement exists, applicable law and mandatory consumer protection rules will determine the relevant rights and obligations.
